Warrant articles/ Ordinance changes: for 2006 Town Meeting
1. Definition of driveway- BOS asked OC to look at definition. RM expressed concern that PB was not involved in the process, because he didn’t want a future disagreement of opinion at public meetings; should the PB be opposed with the final conclusions of the OC. PB and OC agree. Remove the “less then 500’ feet long”. Driveway definition, with excluded verbiage, would apply to ordinance with the “exception of Shoreland Zoning”. This is a State of Maine Shoreland Zoning requirement that the local ordinance cannot be less stringent with. Discussion regarding insurance issue regarding driveway
accessibility; the liability lies on the FD attempting to get from point A to point B. RM recalls Fire Chief, Garry Dyer saying lack of attempt is what FD is liable for, and not the actual success of reaching the structure fire. It is the responsibility of the homeowner to maintain access for emergency personnel. RM and TT will discuss this with Marianne re: contacting town insurance carrier, about liability.
2. Buried power vs. overhead power- Safety & the Comprehensive Plan are the major reasons for this ordinance Discussion: having it be the choice of home owner to have poles above or below ground, but the last pole must be a minimum of 25’ from the structure. Electrical shut-off: 25 feet from dwelling or under window, either way could be tampered with. Consensus: Power from the street onto the property can be above or below ground, but the last pole can be no closer than 25’. Verbiage will be finalized by RM prior to Public Hearing.
3. Abutters- Ordinance committee to include this is their definitions research. RM asked Ordinance Committee to provide the def. of abutter as currently used when we notify abutters and add: “and others, as deemed necessary at the discretion of the PB”.
4. New heating oil tanks: Change to include replacements. Keep letter O, and include “All replacement tanks, inside or outside, must have self-containment”.
5. Camp ordinances – No existing Camp Ordinance Issues: environment impact, impervious area, foot traffic and concentration of people and buildings. Noise is a civil matter and will not be addressed other than currently stated in Site Plan Review. Ordinance Committee is looking into different types of camps. Ordinance Committee will continue to review this and come back to PB with research results.

7. Items of discussion for next Workshop:
A. Policies, Procedures & Bylaws- Board would like to discuss alternates positions to vote and switching terms so that alternates can get into voting positions.
B. Model Notice of Decision. – TT gave PB member’s copies at last regular meeting and it will be discussed in a future workshop.
C. Shoreland Zoning Permit Application
D. Site Plan Determination Form
E. Model Application Form. (Subdivision)
F. Residence Based Business Applications
G. PB discussion with CEO Re: requirements for a permit for above ground fuel storage tanks. (Both above and below 1000-gallon increments).
